Will Congress pass an extension for ARRA COBRA Subsidies?
As of the printing of this publication, Congress has not passed legislation to extend the ARRA COBRA subsidy program. Employees who were “involuntarily terminated” between September 1, 2008 and May 31, 2010 were eligible for “reduced COBRA premiums” (provided they met certain requirements). The program has been extended three times and employers just want to know if it will be extended again.

IRS Issues Cafeteria Plan Guidance in Response to Healthcare Reform
Cafeteria plans are being altered at most companies thanks to the new rules issued by the Internal Revenue Service. If employees enroll their eligible dependents on their health insurance plans, the new cafeteria plan rules allow those employees to make immediate tax-free contributions.

COBRA Subsidy Program Extended through February 2010
In late December 2009, President Obama signed into law changes to the COBRA premium subsidy law that was previously set to expire on December 31, 2009. The extension brings added compliance obligations for employers, as the program has been extended two months through Feb. 28, 2010, the subsidy period is expanded by 6 months to 15 months total and separate notice requirements apply.

Law Protects College Students on Medical Leave
Under H.R. 2851—also known as Michelle’s law—group health plans or insurers may not terminate coverage of a dependent child who is eligible for coverage under a parent’s plan on the basis of being enrolled in a post-secondary educational institution, when that dependent takes a medically necessary leave of absence from school due to a serious illness or injury.

CHIP Reauthorization Act Creates New Special Enrollment Rights, Notice and Disclosure Obligations For Employers
New special enrollment rights, along with notice and disclosure requirements for employers, are among the provisions in the Children’s Health Insurance Program (CHIP) Reauthorization Act of 2009, signed into law by President Obama on February 4, 2009. CHIP is the federal program that gives matching funds to states in order to provide health insurance to low income families with children. The Reauthorization Act expands the program, but is also including new special enrollment rights and notice and disclosure requirements for employers.

Utah Insurance Department Provides Information on Recently Enacted Federal COBRA and Utah mini-COBRA Laws
We've received numerous calls over the past few weeks regarding the recent legislative changes. Please take a moment to familiarize yourself with the information in the link below. For those employers that are Utah mini-COBRA eligible (20 or less employees) it appears that the insurer will be required to notify employees of additional second notice. Those of you who fall under federal COBRA (over 20 employees) have been working with us over the past couple weeks to ensure we are sending out the second notice to the correct employees. COBRA Law update
According to the most recent update we received from the Department of Labor we should have received the official model notices for the new COBRA regulations yesterday March 17th. The model notices have yet to be released. For your information, once the model notices are released the new law states that we have 30 days to get the notices sent out to qualified individuals.
